Gordon Firemark receives Texas Star Award recognizing achievements and contributions to Entertainment Law.

Last week, I attended the UTCLE/Texas Entertainment & Sports Law Association's 33rd annual Entertainment Law Initiative.

On Thursday, I was honored to be recognized as the 2023 recipient of the Texas Entertainment and Sports Law association's Texas Star Award for achievements in and contributions to the field of Entertainment Law. Better still, I was thrilled that it was my friend, colleague and podcast co-host, Tamera H. Bennett, who presented me with the award.

Later that day, I presented a talk on True-Crime Podcasting: What Podcasters and Their Representatives Need to Know.

And on Friday, November 10, Tamera Bennett and I recorded the 162nd episode of Entertainment Law Update live before attendees at the conference.

Guarding Your Digital Presence: A Comprehensive Guide to Spotting and Protecting Against Deepfakes

As a lawyer deeply involved in the realms of digital content creation, podcasting, and media law, I understand the importance of safeguarding one's online identity and intellectual property. In this blog post, we're going to delve into the world of deepfakes – those eerily convincing digital manipulations that can pose a serious threat to both individuals and businesses. I'll guide you through the steps to spot and protect yourself from the ever-evolving deepfake landscape.

What Are Deepfakes?

Before we dive into protection strategies, it’s crucial to understand what deepfakes are. Deepfakes are synthetic media that use deep learning and artificial intelligence to manipulate or create digital content that appears incredibly real. This includes forged videos, audio recordings, and even text. Deepfakes can target anyone, from public figures to everyday individuals, making it essential to stay vigilant.

Recognizing Deepfakes

  1. Inconsistent Facial Expressions: Pay attention to facial expressions that don't match the context or emotion of the content.
  2. Unnatural Lip Sync: Deepfakes may struggle with accurate lip synchronization, leading to misaligned speech and lip movements.
  3. Blurry or Unusual Backgrounds: Look for discrepancies in the background or strange artifacts that don't fit the scene.
  4. Uncanny Valley Effect: Trust your instincts. If something feels off, it might be a deepfake.

Protecting Yourself

  1. Enable Two-Factor Authentication (2FA): Secure your online accounts with 2FA to prevent unauthorized access.
  2. Monitor Your Online Presence: Regularly search for your name online to identify and report any deepfake content.
  3. Watermark Your Content: If you create digital media, watermark it to establish authenticity.
  4. Educate Your Audience: As a content creator or podcaster, inform your audience about the existence of deepfakes and how to verify your content's authenticity.
  5. Work with Legal Professionals: Consider consulting legal experts to draft and enforce contracts that protect your intellectual property.

Reporting Deepfakes

  1. Social Media Platforms: Report deepfake content on social media platforms where it's found.
  2. Copyright Infringement: If the deepfake uses your content without permission, enforce your copyright through legal channels.
  3. Legal Action: In severe cases, consult with an attorney specializing in media law to take legal action against those responsible.

Stay Informed and Vigilant

In the age of deepfakes, it's crucial to be proactive in protecting your digital presence. As someone who offers online courses and workshops, you can empower your audience by providing them with the knowledge and tools to identify and combat deepfakes effectively. Remember, staying informed and vigilant is the first line of defense against this emerging digital threat.

By incorporating these strategies and educating yourself and your audience, you can navigate the digital landscape with confidence, knowing that you're taking the necessary steps to spot and protect against deepfakes effectively.
